the Client and Artist mutually agree to the following terms mentioned on this page.Client must be 18 or older to commission the artist.Client acknowledges that the commissions they are buying from the artist are digital goods only.
I do not offer printing, shipping, or any physical items.I, the artist, retain the right to refuse or cancel any commission at any point in time, in which case the customer will receive a full refund.All information exchanged between the artist and the client during the payment, and discussion process will be treated as confidential. The artist will only use the information exclusively for the execution of the commissioned work, taxes and related administrative purposes.The artist's commissions are for Personal Use only, unless otherwise discussed.
As with the Rights and Limitations mentioned below, you will not profit off my work without a prior written agreement explicitly included in the commission invoice.
➥DESCRIPTION OF SERVICE
The ARTIST will provide the CLIENT one or multiple of the following Services:
A digital illustration or Art of a Character, of which the Character’s design is based upon descriptions provided to the ARTIST. This Service is also known as a Commission.

I, MADYAXX, the artist, retain FULL copyrights to the artwork I create.
This includes, but is not limited to:

Client agrees to Personal Use Only:

If client wishes to keep the commission private, this needs to be addressed and agreed on before starting.Client must credit the artist in any public display or use of the artwork.
Client's Understanding and Limitations:

| Do not: Remove, edit, or otherwise alter my watermark (this includes repainting, making bases, etc). |
| Do not: Copy or trace my work in any way. |
| Do not: Associate my work with NFTs/crypto or AI art/AI programs. |
| Do not: Re-sell, use for merch or use in any profitable ways, unless paid for commercial use. |
Doing any of the above- unless expressively given a permission to- is in violation of these terms and instanly puts client on a black list.

The artist will provide an Initial Cost for the Service which must be paid in full and upfront (within given time) of the Contract’s initiation day. Failure to provide payment will result in a termination of the Contract and cancellation of the Service.
➥Cancellation and refunds
MADYAXX commissions are non-refundable, unless the artist is personally unable to finish your commission.In the rare case where the Client fails to pay for the Service after it's agreed due, the artist has the option to treat this as a breach of Contract, and may cancel the Contract as well as the Service if deemed neccessary. If the Contract is canceled in this manner, the Client will not be refunded the money already paid to the artist.
commercial use
By default, all commissions are sent to client with a solid background colour - no transparent versions will be provided provided unless a commercial fee is paid.The Client may request Commercial rights for the commissioned artwork during the ordering process.Commercial rights can also be bought afterwards.
BUT if the artwork has already been made beforehand, it won't be changed to fit any specifc needs which could have been done had the commercial rights discussion been done before the work begun.
The fee incurred by commercial usage rights is broken into two tiers:

These fees are subject to increase at the scope of the project, such as applying to groups, businesses, and corporations.
With commercial rights, Client may request for their project to remain private to certain lengths. This means that I will not stream work of, post WIPs of, or post completed versions of the project until an agreed upon date in the future.NOTE:
I as the artist reserve full rights to the illustrations created, EVEN when the commercial rights-fee is applied to commission.
Buying commercial rights shares the rights of commercial usage for client, but DOES NOT restrict the artist's rights to the created art.
The commercial rights do not give the client the rights to alter/edit the commission or claim the artwork as your own.
➥delivery process
Wips are given in three stages:
➀: Sketch process. (This is the point where bigger changes to commission can still be made.)
➁: Flat colours: To ensure the colours are correct and to client's liking. Colour changes can still be requested at this point.
➂: Finished piece. Only minimal changes accepted.
Commission process is around 2 to 8 weeks.
This may vary from one way to other depending on the commission size, and your placement in the commission queue.
In the end client will receive a PNG or JPEG of the digital illustration with my watermark.
Other versions are not given, unless a need for specifics is mentioned beforehand.

A design fee will be charged for clients with no reference images, that would like me to draw solely from a description and/or a collection of photos.
Once we have discussed everything, I will send you an invoice through Paypal.
Commission is officially added to queue once its invoice is paid.
Do not send me any payments on your own, you will receive an invoice from me.
In the case when I have a waitlist open, the payment will only be required once your spot on the waitlist officially comes up.
...And when it's paid, I get to work!
